Welcome to PillPerks. By accessing or using our mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our app.
These Terms constitute a legally binding agreement between you and PillPerks ("we," "our," or "us") regarding your use of the PillPerks mobile application and any related services (collectively, the "Service").
We may modify these Terms at any time. If we do so, we will notify you by updating the "Last Updated" date at the top of these Terms and, in some cases, provide you with additional notice. Your continued use of the Service after we have posted modified Terms indicates your acceptance of the modified Terms.
You must be at least 13 years old to use our Service. By using our Service, you represent and warrant that you meet this requirement.
To use certain features of the Service, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update this information to maintain its accuracy. You are responsible for safeguarding your password and for all activities that occur under your account.

Our Service allows you to store and share content, including text, graphics, and other material (collectively, "User Content"). You retain all rights in your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content for the purpose of providing and improving our Service.

The Service and its original content, features, and functionality are owned by PillPerks and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not copy, modify, create derivative works, publicly display, publicly perform, republish, or transmit any material from our Service without our prior written consent.
Our Service includes a rewards program that allows users to earn and redeem points ("Coins" or "Points"). The following terms apply to the rewards program:

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL PILLPERKS, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You may request the deletion of your account and all associated personal information at any time. To do so, please visit our support page and select "Delete My Info request" from the request type dropdown. We will process your request in accordance with our Privacy Policy and applicable laws.
You agree to defend, indemnify, and hold harmless PillPerks, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in Austin, Travis County, Texas.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Before filing a claim against PillPerks, you agree to try to resolve the dispute informally by contacting us at legal@pointcoin.co. We will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 60 days of submission, you or PillPerks may bring a formal proceeding.
You and PillPerks agree to resolve any claims relating to these Terms or the Service through final and binding arbitration, except as set forth under Exceptions to Agreement to Arbitrate below. The arbitration will be conducted by JAMS under its Streamlined Arbitration Rules and Procedures.
YOU AND PILLPERKS AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR PILLPERKS WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, REPRESENTATIVE ACTION, OR CONSOLIDATED ACTION. YOU FURTHER AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL.
You have the right to opt out of the provisions of this Arbitration Agreement by sending written notice of your decision to opt out to legal@pointcoin.co within 30 days of first accepting these Terms. Your notice must include your name and address and a clear statement that you want to opt out of this Arbitration Agreement.
